These Terms of Service (“Terms”) govern your access to and use of the services, website, mobile applications, facilities, classes and offerings of BK Callachan, LLC, doing business as Sana Lagree + Wellness. By creating an account, booking or attending any class, service, or event, or purchasing memberships or packages, you agree to be bound by these Terms.
1. Accounts and Security
| 1.1 | To access certain features, you must create an account with accurate and current information. |
| 1.2 | You are responsible for maintaining the confidentiality of your account credentials and all activity under your account. |
| 1.3 | You must notify us immediately of any unauthorized use or security breach. |
2. Memberships and Services
| 2.1 | To access certain features, you must create an account with accurate and current information. |
| 2.2 | Video surveillance may be used to enhance safety and security. |
| 2.3 | Memberships, packages, and services are non-refundable and non-transferable. |
| 2.4 | Auto-renewing memberships may be cancelled at any time as outlined in your membership package. |
3. Reservations, Bookings, Cancellations, and Waitlists
| 3.1 | All services must be reserved and paid for in advance via our website, booking system, or app. |
| 3.2 | Cancellations must be made at least 12 hours before the scheduled service to avoid losing the credit. Late cancellations or no-shows may incur a fee. |
| 3.3 | Instructors and class schedules are subject to change without notice. Notices may be provided via email or SMS. |
| 3.4 | Waitlisted members are responsible for monitoring notifications. Failure to remove yourself may result in loss of credit or late fees. |
| 3.5 | Changes to ClassPass reservations must be made directly through ClassPass. |
4. Payment and Fees
| 4.1 | Services may not be used unless booked and paid for in advance. |
| 4.2 | All sales are final. |
| 4.3 | Service packages must be used before the posted expiration date. |
| 4.4 | Fees exclude applicable taxes, which are your responsibility. |
| 4.5 | Prices are subject to change. |
5. Force Majeure
Sana is not liable for failure to perform due to causes beyond its control, including natural disasters, severe weather, government restrictions, pandemics, power outages, or equipment failure. Services may be cancelled or rescheduled at our discretion.
6. Health and Participation Requirements
| 6.1 | By using our services, you confirm that you are in good health and able to participate safely. |
| 6.2 | You are responsible for informing us of any changes in health status. |
| 6.3 | You may not attend if you have a contagious illness. |
| 6.4 | Participation in fitness classes is permitted for individuals 15 years and older with parental consent. Minors under 15 may not use wellness services (Infrared Sauna, Cold Plunge, or others). |
| 6.5 | You must sign a separate Liability Waiver prior to participation. |
7. Studio Policies
| 7.1 | New members must arrive 10 minutes early for orientation. Late arrivals may not be admitted. |
| 7.2 | Proper attire is required: grip socks for Lagree classes; swimsuits or spandex for wellness services. |
| 7.3 | Personal belongings are your responsibility; Sana is not liable for lost or stolen items. |
| 7.4 | Respectful conduct is required. Abusive, harassing, or inappropriate behavior will not be tolerated. |
8. Media Release
| 8.1 | By participating, you grant Sana the right to record and use your image, likeness, or voice for promotional purposes unless you notify us in writing beforehand. |
9. Dispute Resolution and Arbitration
| 9.1 | These Terms are governed by the laws of the Commonwealth of Massachusetts. |
| 9.2 | Any dispute shall first be addressed in writing with Sana. |
| 9.3 | If unresolved, disputes will be settled by binding arbitration under the Rules of the American Arbitration Association. |
| 9.4 | You waive the right to jury trial or class action participation. |
| 9.5 | Arbitration must be initiated within one (1) year of the dispute. |
10. Limitation of Liability
To the maximum extent permitted by Massachusetts law, Sana is not liable for indirect, incidental, or consequential damages. Your sole remedy for dissatisfaction with services is a refund of membership or service cost.
